GoAndSmile - Standard Terms and Conditions:

Have you been told that you cannot take an item through Security controls and have to give it up? By forfeiting the item to Security, you lose your property rights in the item. The security company will dispose of the item.

"goandsmile.com"  is a service which will send the item(s) you could not take through Security to an address selected by you. This way, you get your item back in a few days.


By handing over your item(s) to our "goandsmile.com" service at the Security Desk, you accept our Standard Terms and Conditions as follows:

Procedure:
You have brought an item with you which is either dangerous or not permitted. You are required to give up this item at the Security Desk, or you will not be allowed to pass and cannot therefore proceed or cannot attend an event.
Later, your item will be disposed of irretrievably.
To avoid you losing the item permanently, we have developed "goandsmile.com". When you hand over your item to Security, you will receive a receipt with a "collection code". When you then go onto our website www.goandsmile.com at a later time, you can arrange at your leisure for the item to be sent to your choice of address.
We arrange despatch and your item is returned to you in a few days.

Costs:
The "goandsmile.com" delivery service charges a fee for despatch.
This charge covers administration, packing costs, and postal charges based on the type, size and weight of the item.
These charges are shown after a delivery request for the item via our "goandsmile.com" website has been received, and have to be paid before the item is despatched.
If you find the charges too high, and don't therefore request despatch of the item, we then dispose of it after 6 weeks.

For information, our website also displays the amount payable in other currencies. The charges are calculated in Euro and are payable in Euro.

Storage Period:
Your item is stored at our central warehouse.
You must request despatch of the item at "goandsmile.com" within 6 weeks – from date of handover at the Security Desk.
If delivery of the item is not requested within the 6-week storage period, it will be disposed of.
By handing over the item at Security, the owner foregoes his property rights in the item, at the latest when the 6-week storage period has elapsed. There is no entitlement to a credit or replacement in the event that despatch of the item is not requested.

Carriage Restrictions:
It may not be possible for "goandsmile.com" to forward certain items which have been handed over at Security to the specified address. Reasons may include:

  • The postal service, courier service or a particular regulation does not permit despatch of the item or goods.
  • Country of despatch or receipt does not allow the export or import of the item or goods.

The following items e.g. strictly CANNOT be despatched:

  • living and dead animals
  • perishable foodstuffs
  • drugs
  • flammable and explosive materials, munitions
  • harmful chemical and toxic substances, radioactive material
  • money, jewellery, goods and items over a value of € 250
  • items in any way dangerous.

Checking Contents:
"goandsmile.com" reserves the right to check the contents of letters and parcels by x-raying them, opening them or handing them over to the appropriate authorities, or to advise the latter that the service is being used,
not to despatch items and to destroy items immediately (e.g. perishable goods). 

Additional Costs:
The Service user is responsible for the legality of the contents being despatched.
He/she is also responsible for complying with the respective customs or import  or export regulations of the countries in question.
Any customs, taxes or charges at the other end are not included in our quoted prices. These are to be borne by the Service user.
Charges may be levied for the disposal of perishable goods, dangerous goods or other goods where despatch is not permitted. Other improper use of our service may also incur additional charges.

Delivery Dates:
"goandsmile.com" collects the "forfeited items" and sends them –when requested via our website- to the address you specify. The goods will be sent by normal post or by courier service. We cannot guarantee a specific delivery date.
If the goods cannot be delivered and are returned to our warehouse, you will receive a mail notification and have the chance to request delivery of the item again within 14 days – for an additional charge - to another address.
If delivery is not requested again within this period, or if the goods are returned to us again, we shall then dispose of them.

Liability:
"goandsmile.com" will endeavour to despatch your item within 10 days after your delivery request is received. We cannot guarantee a specific delivery date  or a maximum posting time.
"goandsmile.com" cannot guarantee furthermore that you actually receive the requested item.
The items may possibly be checked by external transport companies or the authorities en route from the Security Desk to our warehouse, or on the way from us to your specified address. If the items are illegal, they may be seized by the authorities, without us being notified.

"goandsmile.com" cannot be held liable for items and goods which are lost, damaged or spoiled.

If "goandsmile.com" acts in a grossly negligent manner within areas of its own responsibility, (between receiving items at its warehouse and despatch), the maximum liability is limited to € 50 per event.

System users are responsible for the correctness of the details they give us - via our website. This applies to correct sender and recipient addresses and particularly to correct details of the contents and value. The user is liable for all damages and costs that arise due to false statements.

Right of Ownership:
The user of the system needs to be owner of the item or be authorized to possess it. By handing over the item at the security control, the user gives up his right of ownership in the goods. By handing over an item, users of the system also accept the standard terms and conditions of "goandsmile.com".

"goandsmile.com" reserves the right to change these terms and conditions at any time.

Place of Jurisdiction: 
German Law is applicable. Place of jurisdiction is  Coburg, Germany.
